At the heart of this initiative is the conservation easement -a voluntary legal agreement between a landowner and a qualified conservation organization or government agency. This agreement limits development of land to preserve natural, scenic, or agricultural values, while allowing the landowner to maintain ownership and traditional use.
In exchange, the landowner may be eligible for a Colorado state income tax credit worth up to 80 to 90%of the appraised value of the easement capped at $5 million. What makes the program especially effective is that these tax credits are transferable. That means they can be sold to other Colorado taxpayers, offering a flexible, market-driven way to benefit financially while protecting the state’s natural heritage.
